No charges pending following shooting incident
A Cape Coral man and a second person sustained minor injuries in a shooting Sunday night.
At about 11:30, police responded to a call about a shooting at 3311 S.E. 15th Ave. Upon arrival, officers spoke with Travis Grams, 34, of 2352 Barcelona Ave., Fort Myers, who reported that he had been shot at and hit by a ricochet bullet on his left ankle. He refused medical attention on scene.
Inside the home, police located Justin Phillip White, 33, of 119 N.W. Seventh St. He had been shot in the lower part of his left leg with ricochet. White was taken to Lee Memorial Hospital for treatment.
According to the police report, Grams stated that possibly five or six white men approached the residence and one of the men started shooting at him and White. He added that eight to 10 shots were fired in his direction until the group turned around and ran westbound on Southwest 34th Street.
Grams said he ran after the group but could not catch them. He did not know any of the men.
Grams added that he believed the gun used in the incident was a revolver.
He declined to press charges and would not submit a statement.
Another witness, Erica Nicole Tharp, 31, of 3311 S.E. 15th Ave., told police that she was on the front porch with her two children when the shooting occurred. She said she saw the group walk up but could not hear what they were saying. When one man started shooting, she rushed her kids inside the home.
Randolph Tharp Jr., 41, of 8151 Hart Drive, North Fort Myers, walked outside of the residence when the shooting began. He told officers that he believed two men from the group of five shot at Grams and White. Tharp then drove around the area in his vehicle looking for the group but could not find them.
The two witnesses also declined to submit a statement to police.
On scene, police confirmed that Tharp had an active out-of-county warrant from Sarasota. He was taken into custody and transported to the Lee County Jail for booking. Tharp has since been released.
According to the report, officers later attempted to speak with White at the hospital.
He declined to press charges and would not submit a statement to police.
The investigation was ended due to the involved parties not wanting to press charges. The Florida Department of Children and Families was notified of the incident due to children being present.
White’s condition was unknown Tuesday as he was not in the hospital’s patient directory.
