No charges filed in alleged bar altercation
Three Fort Myers Police Department officers have been returned to duty after the State Attorney’s Office said it will not seek charges relating to an alleged altercation outside a Cape Coral bar in February.
The officers, who were off duty, were placed on administrative leave pending the outcome an investigation.
FMPD was notified of the incident by the Cape Coral Police Department and subsequently suspended the officers with pay, the agency said previously.
As per policy, the FMPD will now conduct an internal investigation, the agency said in a release issued late Friday.
“The State Attorney’s Office of the 20th Judicial Circuit has notified FMPD that they will not be seeking charges against three off duty Fort Myers Police officers concerning an incident that occurred on February 20, 2020, at the Dixie Roadhouse, 1023 SE 47th Terrace, Cape Coral, Florida,” the release states. “The Fort Myers Police Department will now proceed with an Internal Affairs Investigation to determine if the officers violated department policy during this incident.”
“The officers have returned to duty pursuant to FMPD Standard Operating Procedures,” the release adds.
There will be no further comment pending the outcome of the Internal Investigation, officials said.
