Commission approves applications

JIM LINETTE Planning commissioners Tuesday approved an application for continued use of a nonconforming office building at 1177 Causeway Boulevard about to change ownership, but remain as a real estate and property rental management usage.

A real estate office next to the Sanibel Captiva Chamber of Commerce visitor center on Causeway Boulevard will be allowed to continue in its current usage when the Sanibel Planning Commission gives final approval to its application.

Because the building and its usage was established before Sanibel incorporated as a city, commissioners approved an application to amend certain conditions of a specific amendment ordinance allowing the continued noncomforming use as an office. The application will come back before the commission in resolution form at the next meeting on May 28. It them must go to City Council for their approval.

The property at 1177 Causeway Boulevard, owned by Charles Howey, has a pending sale contract scheduled to close soon. The attorney who filed the application for Howey, Richard Collman, told the panel the buyer plans to keep the property conducting real estate sales and rentals transactions.

The building was expanded in 1982 and a sunset clause established for its nonconforming use to expire in 2007. That sunset provision will be repealed with the resolution approval. Sanibel Code allows for the reconstruction of such structures devoted to nonconforming uses when destroyed or substantially damaged by natural disaster.

Planning Department director James Jordan informed the commissioners that the request is consistent with the provisions of the Sanibel Code and recommended the application’s approval.

In other business before the commission, the final resolution approving an application for expansion of an existing dock and installation of a boat lift on Woodring Road was approved. The property and existing dock are in the bay beach zone and was first approved at the April 23 commission meeting.
