No charges filed against man accused in robbery, shooting
The state found insufficient evidence to file official charges against a man accused of robbing and shooting a person during an alleged drug deal.
The State Attorney’s Office decided not to file charges against Eric Bernard Otto, 23, of 3628 Crestwood Lake Drive, Apt. 307, on May 4 because of insufficient evidence to prove beyond a reasonable doubt, documents state.
Defense attorney Regine Emile represented Otto.
She did not immediately return a message seeking comment Thursday.
Otto had been booked into the Lee County Jail in April on one count each of robbery with a weapon and aggravated battery person uses a deadly weapon.
He was accused of brokering a deal with a woman who he had met at a pain clinic to purchase her leftover Oxycodone pills for cash.
The woman sent her fiance to meet with Otto and reportedly exchange the Oxycodones for cash.
Authorities reported that Otto attempted to leave without paying and the fiance grabbed him. Otto reportedly shot the man in the stomach.
The man drove himself to a nearby gas station, where the store clerk called police.
Otto could not be reached for comment Thursday.
Assistant State Attorney Sara Miller was assigned to the case.
