A 74-year-old Cape man was charged with lewd and lascivious behavior after he was accused of exposing himself to child riding a scooter past his home.
Thomas J. Gallagher, of 1100 Pondella Road #811 was charged him with two counts of lewd and lascivious behavior victim less than 16 years old after he exposed himself and performed a sex act in view of a 10-year-old girl, police said.
On Nov. 4, the mother of the child reported to Cape police that on Sunday, Nov. 1, Gallagher exposed himself to her daughter as she was riding her scooter past his lanai. One week later, on Nov. 8, Gallagher again exposed himself and was performing a sex act as she rode by on her scooter, police said in a prepared statement released Tuesday.
An investigation by Det. Christy Jo Ellis found probable cause to arrest Gallagher and charge him with two second degree felonies. He was taken into custody and transported to Lee County Jail.
